Claque Terms of Service

These Terms of Service govern your Claque account and your use of the Claque service provided by CEGSJ LLC. They do not replace Apple's Standard End User License Agreement, which governs the license to the downloaded Apple-platform app.

Eligibility

You must be at least 13 years old to use Claque. When creating an account or accepting these Terms, you must affirm: "I attest that I am 13 years of age or older." If the law where you live requires a parent or guardian to consent to your use, you may use Claque only with that consent.

Accounts

You must provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except to the extent applicable law provides otherwise. You may sign in through supported identity providers or with supported email credentials. Signing out ends only the current session and does not delete your account.

Claque Plus subscriptions

Claque may offer auto-renewing Claque Plus subscriptions through Apple's App Store. Apple handles purchase, billing, renewal, refund, and cancellation under your Apple account and applicable App Store terms. Your subscription renews automatically unless you cancel it through your Apple subscription settings before the renewal date. Deleting Claque or your Claque account does not itself cancel an App Store subscription.

Subscription features and limits are shown before purchase. When a subscription expires, Claque may restrict new activity on features or boards above the free limits, but subscription expiry does not by itself delete your boards, messages, or sharing grants.

Your content

You retain the rights you have in messages, board names, display names, and other content you submit. You grant CEGSJ LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and process that content only as needed to operate, secure, improve, and provide Claque, comply with law, and enforce these Terms. You represent that you have the rights needed to submit the content and grant this license.

Public and private boards

An owned board is private by default. Only the owner may read a private board's current content and history; authorized senders have write-only access and cannot read that content or history.

If an owner changes a board to public, anyone who can address the board identifier may read its current content without signing in. Do not put confidential, sensitive, or personal information on a public board. Message history remains subject to Claque's authenticated access rules.

Acceptable use

You may not use Claque to:

• violate law or another person's rights;
• harass, threaten, exploit, defraud, impersonate, or endanger anyone;
• submit unlawful, hateful, sexually exploitative, or otherwise abusive content;
• disclose personal or confidential information without authority;
• send spam, malware, or deceptive communications;
• interfere with, probe, overload, reverse engineer, or bypass security or access controls, except where law expressly permits;
• access another person's account, private board, or data without permission; or
• use automated access in a way that exceeds documented interfaces or harms the service.

Moderation and reporting

You may report suspected abuse or violations through the reporting methods Claque makes available. Reports may include the reported content, relevant account and board information, the reporter's explanation, and review or resolution records. We may investigate, preserve evidence, restrict content or access, and take proportionate action. We do not promise to monitor every board or message, and moderation decisions may be incomplete or mistaken.

Account and board deletion

You may delete an owned board or your account through the available account controls. Deleting an owned board deletes that board, its history and receipts, and related ownership, sharing, placement, invite, and notification records.

Deleting your account hard-deletes your account, linked identities, sessions, devices, owned boards, and sharing grants. Messages you authored on another owner's remaining board may stay there, but Claque removes the link to your identity. Signing out does not delete this data. App Store subscription cancellation is separate.

Suspension and termination

We may suspend, restrict, or terminate access, remove content, or preserve relevant records when reasonably necessary to protect users or the service, investigate abuse, comply with law, or address a material breach of these Terms. Where appropriate and legally permitted, we will provide notice and an opportunity to appeal or correct the issue. You may stop using Claque at any time.

Service providers and third parties

Claque relies on service providers and third-party platforms for functions such as hosting, data storage, authentication, email, push notifications, app distribution, and subscription processing. Their services may be governed by their own terms and privacy notices. Apple governs the downloaded app license under Apple's Standard End User License Agreement and administers App Store subscriptions. Claque is not responsible for third-party services to the extent permitted by law.

Disclaimers

To the maximum extent permitted by law, Claque is provided "as is" and "as available." We do not warrant uninterrupted or error-free operation, permanent availability of content, or that Claque will meet every requirement. We do not disclaim warranties, remedies, or consumer guarantees that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, CEGSJ LLC and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill arising from Claque.

To the maximum extent permitted by law, their total liability arising out of or relating to Claque or these Terms will not exceed the greater of US$100 or the fees you paid for Claque in the 12 months before the event giving rise to the claim. These limits do not apply to rights or liabilities that cannot legally be limited, including any mandatory consumer rights.

Changes to these Terms

We may update these Terms. We will identify the displayed revision and make the current Terms available before they take effect when required. A display-only correction does not require a new acceptance. If a change is material, we will increment the Terms acceptance revision, provide appropriate notice, and require you to reaccept before further human-account or personal-access-token use of gated Claque features. Your mandatory rights remain unaffected.

Governing law and venue

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules. Subject to mandatory law, disputes must be brought in the state or federal courts located in Maine, and each party consents to their jurisdiction.

This choice of law and venue does not deprive you of mandatory consumer protections, rights, remedies, or courts available under the law of your country, state, province, or other place of residence.
